Think about this: your opponent is chartered in state A, has corporate headquarters in state B, manufactures its products in state C and country D, and has major sales and distribution centers in other states and a global online presence.
Where are you allowed sue them?
Furthermore, which of these potential locations will have the most favorable laws, procedures, and juries? These are questions our litigation attorneys are prepared to answer. Choosing the most favorable jurisdiction or laws can have a huge impact on your case.
What Are Complex Litigations?
The term “Complex Litigation” refers to situations where there may be more than two parties, multiple claims, class actions, and multiple jurisdictions. Complex business litigation cases will typically be in federal court and governed by the Federal Rules of Civil Procedure (FRCP). The FRCP sets forth special rules and procedures for complex cases. It may be possible to consolidate cases against multiple parties. There are may be special penalties if an opposing party is uncooperative.
The first rule of the FRCP states: “[These rules] should be construed and administered to secure the just, speedy, and inexpensive determination of every action and proceeding.” Our law firm brings this ethic to our complex litigation practice here in New York, as well as nationwide.
Complex Commercial Litigation Process
Complex litigation often involves huge evidentiary investigations. There can be literal truckload(s) of evidentiary documentation to sort through. Our attorneys use the most sophisticated discovery techniques, including e-discovery, to find the information you need to win the case. The success of complex business litigation cases often comes down to the diligence of the attorney in this phase of the litigation. We will leave no stone unturned.
Complex cases may often come down a “battle of the experts.” Nowadays, you can find a so-called “expert” to say just about anything. In fact, there are “professional expert witnesses” who do nothing but testify in cases. Even if you’re opponent is dead wrong, they will have an expert witness with impressive sounding credentials to back up their case. Therefore, you need a legal team who can handle these phony experts. Furthermore, you need attorneys who have the integrity to find legitimate experts, even if it may be easier to find a phony.
Business Litigation Class Action Lawsuits
Class action lawsuits fall within the category of complex litigation. A class action suit is appropriate where many individuals small claims – claims that may be too small to be pursued individual, but collectively amount to a substantial claim. If a company causes $15 of damage to 1 million customers, that’s too small for any individual to pursue, but nobody should be allowed to get away with $15 million in damage. Class action suits may involve anywhere from a handful to thousands of plaintiffs, many of whom will be unknown.
Our attorneys and staff have the experience and diligence to handle the most complex of cases. Dot hesitate to contact our NYC office any time any day of the week. We are standing by to extend our help.
